Terms & Conditions for accompanied children (aged 0-5)

At BilinguaSing we want to ensure that both you and your child experience a wonderful time in class.  To this end, we kindly request that you embrace and comply with these terms and conditions at all times as these are the terms on which we supply our services.

Please read these terms carefully before you submit your Booking Form to us. These terms tell you who we are, how we will provide services to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us.

1.   About these Terms and Conditions

By submitting a Booking Form to BilinguaSing, you are signifying your agreement to and acceptance of our Terms and Conditions. All references to the Terms and Conditions refer to these Terms and Conditions as amended and updated from time to time.

The Parent acknowledges and accepts that it is contracting with their local BilinguaSing franchisee and not BilinguaSing Limited. Therefore, the Parent shall have no cause of action whatsoever against BilinguaSing Limited whether in contract or otherwise.

If we have to contact you, we will do so by telephone or by writing to you at the email address or postal address you provide to us in your Booking Form.

2.   About Us

BilinguaSing Limited is registered in England and Wales under Company Registration Number 09299917. Our registered office address is 16 Hearne Drive, Maidenhead, SL6 2HZ. We are registered with the Information Commissioner’s Office (ICO) for data protection reference number A8274943.

3.   Definitions

“Agreement”               means these Terms and Conditions and the Booking Form.

“BilinguaSing”             means the franchisee of BilinguaSing Limited with whom the Parent has entered into this Agreement.

“Booking Form”          means the form relating to the booking of the Class(es) and which incorporates these Terms and Conditions.

“Carer”                        means the person/persons who attend the Class(es) or any part of it, with the Child as authorised by the Parent.

“Child” / “Children”    means the child or children who attend the Class(es) whose details are specified by the Parent on the Booking Form and any other child otherwise permitted by BilinguaSing to attend the Class(es) with the Parent or Carer.

“Class(es)”                  means a class / classes taught by BilinguaSing at the Venue.

“Fee”                           means the amount payable for the Class(es) as detailed in the Booking Form.

“Free Taster Class”      means the specific Class the Parent and Child together attend free of charge and which are subject to these Terms and Conditions

“Parent”                      means a parent or legal guardian who will be responsible for the payment of fees, and who is the contracting party to this Agreement.

"Term "                       denotes the periods throughout the year during which we run regular Classes.

“Venue”                      means the place at which BilinguaSing provides the Class(es).

4.   Booking and Payment

Classes must be booked using the Booking Form and the Fee must be paid in advance of the Term or the Class.

Payment of the Fee shall be due to BilinguaSing within 7 (seven) days from the date the Booking Form is submitted by the Parent. If payment is not received within 7 days from the date the Booking Form is submitted, a Child’s place is not confirmed or guaranteed.

Only when the Booking Form and payment of the Fee is received will your booking be confirmed.

If we are unable to accept your booking and the Fee has been paid, we will inform you of this in writing and refund you the Fee paid.

Term and Class dates are available to view on the local page of the BilinguaSing website: bilinguasing.com.

The Fee is non-refundable under any circumstances except with the prior written agreement of BilinguaSing, unless, where the Child is booked for a Term, the Child has attended a Class for the first time and within 5 days of the end of that Class the Parent has given written notice that the Child will not be continuing to attend the remainder of the Term. The Fee already paid will be refunded in full to the Parent by BilinguaSing. This exception does not apply where a Child has already booked and attended a Free Taster Class.

No portion of the Fee will be refunded once the Term has begun and Classes have started or for any Class(es) which have been missed except as stated above.

Notwithstanding the aforementioned, BilinguaSing is unable to offer concessions for missed classes due to sickness or holidays, in certain circumstances and solely at the discretion of BilinguaSing, the following options may be available:

  • The Child’s place at the specific Class may be offered to the child of a friend or acquaintance provided adequate notice is given and the friend or acquaintance completes a Booking Form and expressly agrees to these Terms and Conditions;
  • Subject to availability, adequate notice and without any guarantee, BilinguaSing may be able to fit the Child into another Class that week at an alternative venue.

Missed Class(es) cannot be carried over to the next Term.

5.   Changes to Classes and Cancellation

BilinguaSing may cancel this Agreement at any time and for any reason whatsoever. If the Agreement is cancelled by BilinguaSing, the unused portion of the Fee will be refunded to the Parent.

If for any reason the usual teacher is unable to run a Class, then BilinguaSing will do its best to provide another BilinguaSing teacher. If this is not possible, BilinguaSing will, at its sole option, either (i) reschedule the Class by adding another Class during the half term or end of term break, or (ii) will refund the Fee for that Class.

The Parent acknowledges and agrees that BilinguaSing reserves the right to replace any teacher of a Class without notice to the Parent at any time prior to that Class without any liability arising from such a change except in accordance with these Terms.

Parents may book one Free Taster Class subject to these Terms and Conditions. Bookings submitted for the Free Taster Class are at all times subject to availability and not guaranteed.

6.   BilinguaSing Classes

BilinguaSing will provide Classes which:

  • conform in all material respect to their description;
  • are carried out with reasonable skill and care;
  • be fit for the purpose that BilinguaSing determine it is fit for, or the purpose for which the Parent uses the Classes in mind of their description; and
  • comply with all applicable statutory and regulatory requirements for supplying the Classes in the United Kingdom.

These Terms apply to any replacement Classes BilinguaSing supply to the Parent in the unlikely event that the original Classes do not conform with these Terms.

Parent /Carers are not permitted to use the Classes or information received from the Classes for any commercial purpose.

7.   Attending Classes – Code of Conduct

In order to create a relaxed and comfortable environment for all attendees, we ask that you comply with the code of conduct below:

  • Classes will start on time and Parents / Carers must arrive 5 minutes before the Class.
  • During the Class, mobile phones must either be switched off or on silent.
  • The BilinguaSing environment is relaxed and sociable, however to show respect for the group, general chatter must be kept to a minimum to ensure that the teacher can be heard and that the focus is kept on the children.
  • Classes are sometimes held in venues with hard surfaces and, although mats are provided, Parents / Carers may like to bring a small blanket to lay a child on.
  • While we encourage participants to drink water in class, we ask that no food is consumed during the Class. If a child needs to be fed for medical reasons please ensure this information is provided on the Booking Form. Babies are welcome to be bottle-fed or breastfed at any time during the Class.
  • If the teacher of a Class determines that the Parent / Carer and Child are disruptive, the teacher on behalf of BilinguaSing, shall be entitled to exclude the Parent / Carer and Child from the Class. The Parent / Carer agrees that the determination of whether a Parent / Carer and / or Child is disruptive will be determined by the BilinguaSing teacher and the Parent agrees and accepts that the decision of the BilinguaSing teacher is final.

8.   Parent / Carer Responsibilities

The Parent warrants and represents that:

  • the information set out in the Booking Form whether completed and or accepted / signed by the Parent or by the Carer on behalf of the Parent, is accurate in all respects and the Parent will notify BilinguaSing of any change in such information immediately;
  • when attending a Class, neither the Child nor the Parent / Carer will be knowingly suffering from any illness, infectious disease or anything similar thereto;
  • there will be at least one Parent / Carer for every two Children that are booked by the Parent to attend the Class.

The Parent agrees that if he or she cannot attend the Class with the Child, he or she will provide a Carer at each Class for the Child. A Child will be not allowed to attend the Class without being accompanied by either a Parent or Carer.

The Parent is responsible for ensuring that the Carer complies with these Terms and Conditions at all times.

The Parent acknowledges and agrees that:

  • he or she is solely responsible for the health, safety, welfare and care of the Child;
  • the Child will not be left unattended at any time;
  • the Child attending the Classes shall be deemed to be under the Parent or the Carer’s direction care and control throughout the Classes and the Parent / Carer shall be responsible for the welfare and conduct of the Child throughout the Classes
  • it is the Parent / Carer’s decision as to whether or not to participate in the activities proposed by the BilinguaSing teacher during the Class and that the Parent / Carer can opt out of any activities that he or she considers to be unsuitable for the Child;
  • the Parent / Carer is solely responsible for supervising the Child and their use of any props;
  • the Parent / Carer will comply with all health and safety rules and procedures in place at the Venue where the Class is held.

The Parent shall indemnify and keep indemnified BilinguaSing against all loss, liability, costs and expenses which BilinguaSing shall incur directly or indirectly as a consequence of any action or inaction of the Parent, the Carer or the Child.

9.   Limitation of Liability

BilinguaSing shall not be responsible for any loss that a Parent / Carer suffers as a result, except for those losses which it could reasonably foresee would result from the failure to comply with these Terms and Conditions.

BilinguaSing shall not be responsible to the Parent, Carer or Child for losses that result from its failure to comply with these Terms and Conditions including, but not limited to, losses that fall into the following categories:

  • loss of income or revenue;
  • loss of business;
  • loss of anticipated savings; or
  • loss of data.

This clause shall not prevent claims for foreseeable loss of, or damage to, the Parent’s physical property.

This clause does not exclude or limit in any way BilinguaSing’ liability for:

  • death or personal injury caused by our negligence; or
  • fraud or fraudulent misrepresentation; or
  • any breach of obligations under the Consumer Rights Act 2015
  • any other matter for which it would be illegal or unlawful for BilinguaSing to exclude or attempt to exclude its liability.

The Parent agrees that any claim against BilinguaSing or any teacher, practitioner, employee or agent of BilinguaSing must be brought within 60 days of the event that gave rise to such claim. The Parent agrees any claim made thereafter should be discussed.

The Parent acknowledges, warrants and undertakes that the maximum aggregate liability of BilinguaSing to the Parent under these Terms and Conditions shall not exceed the Fee paid.

All warranties and conditions whether implied by statute or otherwise are so far as is permitted excluded from these Terms and Conditions.

10.         Data Protection

BilinguaSing acts a Data Controller in relation to services supplied under these Terms and Conditions and the person responsible for data protection matters is Ellie Baker.

The Company will adhere to all applicable data protection laws and always stores data sent to us in a secure manner as outlined in our Privacy Policy.

The Company shall ensure that data processing only takes place in accordance with the terms of this Terms and Conditions and any Data Processing Agreements in place from time to time. The Company only processes personal data where it has a lawful basis to do so.

The Company may store and process personal data via our servers located in the EU, or any other country that provides suitable and adequate security measures to protect the data. Data will be transferred in accordance with the relevant data protection laws.

We retain the right to respond to legal requests as necessary.

11.         Personal Data

BilinguaSing shall uphold all rights in relation to the use of a data subjects’ personal data. The rights of data subjects are contained within our Privacy Policy.

As permitted under data protection legislation, we will store a Client’s data for as long as necessary in order to provide our services to the Client. Information associated with your account will be kept until your account is deleted, unless the information is no longer needed for the purposes agreed or for other legitimate purposes.

Once our relationship with you as a user of our classes has terminated, we will retain personal information only to comply with legal requirements, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, enforce our Terms and Conditions, and take any action permitted by law.

We do not pass Clients’ information to any third parties except those who have contractually agreed to abide by our service Terms and Conditions. Your data will not be used or sold outside of the agreed Terms and Conditions.

12.         Intellectual Property

BilinguaSing reserves the right to all intellectual property in relation to this website and the services provided. Use of the services does not give the user any ownership in the services, its content or any trademark or logo used on the website.

Any information or material provided to us is on the basis of a non-exclusive, irrevocable, perpetual and royalty free licence to use such information and material in relation to the services we provide under our Terms and Conditions.

13.         Changes to Terms and Conditions

These terms and conditions may be modified from time to time and you are advised to check this page to see that you are reading the most up-to-date Terms and Conditions.

By accepting our Terms and Conditions, you consent to our collection, storage, use and disclosure of your personal information as described in our Privacy Policy.

14.         Force Majeure

BilinguaSing will not be liable or responsible for any failure to perform, or delay in performance of, any of its obligations under the Agreement that is caused by events outside its reasonable control. Such causes include, but are not limited to: power failure, internet service provider failure, industrial action, civil unrest, fire, flood, storms, earthquakes, acts of terrorism, acts of war, governmental action or any other event that is beyond the control of BilinguaSing.

15.         Severance

Each of the paragraphs of these Terms and Conditions operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

16.         No waiver

The failure by either party to enforce any obligation under these Terms and Conditions at any time or for any period shall not be a waiver of them or of the right at any time subsequently to enforce all the obligations arising under these Terms and Conditions.

17.         Entire Agreement

These Terms and Conditions constitute the entire agreement between the parties and supersede all prior agreements and understandings between the parties. It is agreed that no statement, promise or inducement whether written or oral alleged to have been made by either party and which is no contained herein shall be binding or form part of these Terms and Conditions.

18.         Rights of Third Parties

No term of the Terms and Conditions will be enforceable under the Contracts (Rights of Third Parties) Act 1999 by any person who is not a party to it.

19.         Governing law and Jurisdiction

This Agreement shall be governed by English law and each party irrevocably submits to the exclusive jurisdiction of the English courts.

Terms & Conditions for unaccompanied children (aged 4-11)

“Class(es)”                  means a class / classes taught by BilinguaSing at the Venue.

“Fee”                           means the amount payable for the Class(es) as detailed in the Booking Form.

“Parent”                      means a parent or legal guardian who will be responsible for the payment of fees, and who is the contracting party to this Agreement.

"Term "                       denotes the periods throughout the year during which we run regular Classes.

“Venue”                      means the place at which BilinguaSing provides the Class(es).

“We” / “we”               means BilinguaSing (as defined above)

“You” / “you”              means the Parent (as defined above)

4.   Interpretation

Unless the context otherwise requires, references to the singular include the plural and references to the masculine include the feminine, and vice versa.

The headings contained in these Terms and Conditions are for convenience only and do not affect their interpretation.

References to any statute or statutory provision shall, unless the context otherwise requires, be construed as a reference to that statute or provision as from time to time amended, consolidated, modified, extended, re-enacted or replaced.

5.   Booking Classes and Payment

Classes must be booked using the Booking Form and the Fee must be paid in advance of the Term or the Class.

Payment of the Fee shall be due to BilinguaSing within 7 (seven) days from the date the Booking Form is submitted by the Parent. If payment is not received within 7 days from the date the Booking Form is submitted, a Child’s place is not confirmed or guaranteed.

8.   BilinguaSing Classes

BilinguaSing will provide Classes which:

  • conform in all material respect to their description;
  • are carried out with reasonable skill and care;
  • be fit for the purpose that BilinguaSing determine it is fit for, or the purpose for which the Parent sends the Child to the Classes in mind of their description; and
  • comply with all applicable statutory and regulatory requirements for supplying the Classes in the United Kingdom.

These Terms and Conditions apply to any replacement Classes BilinguaSing supply to the Parent in the unlikely event that the original Classes do not conform with these Terms and Conditions.

Parent /Carers are not permitted to use the Classes or information received from the Classes for any commercial purpose.

9.   Attending Classes – Code of Conduct

In order to create a relaxed and comfortable environment for all attendees, we ask that Parents and Children comply with the code of conduct below:

Children will be asked to listen to and comply with the BilinguaSing teacher’s instructions as regards to their conduct and behaviour during the Class. Parents / Carers are asked to encourage their Child to listen to and comply with the BilinguaSing teacher’s instructions.

Children are welcome to bring (food) snacks and drink with them along to the Class however, (food) snacks are only to be consumed during the snack periods specified and supervised by the BilinguaSing teacher.

If the BilinguaSing teacher of a Class determines that the Child is disruptive in the Class, the teacher on behalf of BilinguaSing, shall be entitled to exclude the Child from future Classes and terminate this Agreement in accordance with clause 3.10. The Parent agrees that the determination of whether a Child is disruptive will be determined by the BilinguaSing teacher and the Parent agrees and accepts that the decision of the BilinguaSing teacher is final.

10.         Parent / Carer Responsibilities

The Parent warrants and represents that:

the information set out in the Booking Form whether completed and or accepted / signed by the Parent is accurate in all respects and the Parent will notify BilinguaSing of any change in such information immediately; and

  • when attending a Class, the Child is not known to be suffering from any illness, infectious disease or anything similar thereto.
  • The Parent is responsible for ensuring that the Carer complies with these Terms and Conditions at all times.
  • The Parent acknowledges and agrees that:
  • he or she is solely responsible for the health, safety, welfare and care of the Child when with the Child;

Where a Class runs at the end of the school day, the Parent / Carer will pick up / collect the Child from the Class at the precise time the Class finishes and from the designated area of the Venue as specified by BilinguaSing in advance of the Class

when on the Venue, the Parent / Carer will comply with all health and safety rules and procedures in place at the Venue where the Class is held.

The Parent shall indemnify and keep indemnified BilinguaSing against all loss, liability, costs and expenses which BilinguaSing shall incur directly or indirectly as a consequence of any action or inaction of the Parent or the Carer and any breach of these Terms and Conditions.

11.         Exclusion of Liability

If BilinguaSing does not comply with these Terms and Conditions it shall not be responsible for any loss that the Parent, Carer or Child suffers as a result, except for those losses which it could reasonably foresee would result from the failure to comply with these Terms and Conditions.

BilinguaSing shall not be responsible to the Parent for losses that result from its failure to comply with these Terms and Conditions including, but not limited to, losses that fall into the following categories:

12.         Fair Processing Notice or Audio or Visual Records and Photographs

BilinguaSing may take and use audio or visual recordings and photographs of your Child for the following purposes:

  • to be displayed on the BilinguaSing website;
  • to be displayed on BilinguaSing administered social media platforms;
  • to appear in BilinguaSing publications (including, but not limited to, prospectuses, marketing materials and annual reports)
  • general publicity purposes

If you have any concerns about or wish to opt out to audio or visual recordings and photographs being taken of your Child generally or in relation to any particular BilinguaSing occasion, activity or event, please contact your local BilinguaSing branch in advance.

If you would like us to remove any specific audio or visual recording or photograph of your Child from an existing BilinguaSing publication, website or display, please contact BilinguaSing Limited by emailing us at info@bilinguasing.com.

13.         Data Protection

15.         Intellectual Property

BilinguaSing reserves the right to all intellectual property in relation to this website and the services provided. Use of the services does not give the user any ownership in the services, its content or any trademark or logo used on the website.

Any information or material provided to us is on the basis of a non-exclusive, irrevocable, perpetual and royalty free licence to use such information and material in relation to the services we provide under our Terms and Conditions.

16.         Force Majeure

BilinguaSing will not be liable or responsible for any failure to perform, or delay in performance of, any of its obligations under the Agreement that is caused by events outside its reasonable control. Such causes include, but are not limited to: power failure, internet service provider failure, industrial action, civil unrest, fire, flood, storms, earthquakes, acts of terrorism, acts of war, governmental action or any other event that is beyond the control of BilinguaSing.

18.         Severance

Each of the paragraphs of these Terms and Conditions operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

19.         No Waiver

The failure by either party to enforce any obligation under these Terms and Conditions at any time or for any period shall not be a waiver of them or of the right at any time subsequently to enforce all the obligations arising under these Terms and Conditions.

20.         Entire Agreement

These Terms and Conditions constitute the entire agreement between the parties and supersede all prior agreements and understandings between the parties. It is agreed that no statement, promise or inducement whether written or oral alleged to have been made by either party and which is no contained herein shall be binding or form part of these Terms and Conditions.

21.         Rights of Third Parties

We may transfer our rights and obligations under the Agreement to another organisation. We will contact you to let you know if we plan to do this.

You may only transfer your rights or your obligations under the Agreement to another person with our written consent.

No term of the Terms and Conditions will be enforceable under the Contracts (Rights of Third Parties) Act 1999 by any person who is not a party to it.

22.         Governing Law and Jurisdiction

This Agreement shall be governed by English law and each party irrevocably submits to the exclusive jurisdiction of the English courts.
